ARTICLE I.  IN GENERAL

Sec. 27-1.  Definitions.

The following words when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Board means the park and recreation board established by city ordinance.

Director means the director of parks and recreation.

Park means any park, playground, boulevard, lake, river, stream, recreational center, zoo area, golf course, ballpark, or any other area outside of or in the city and devoted to active and passive recreation.

Vehicle means any motorized or unmotorized wheeled conveyance and trailers in tow of any size, kind or description, excluding bicycles.

Sec. 27-2.  Filling position of park director.

When filling a vacancy for the position of park director, the mayor shall submit the proposed candidate's name to the park board prior to submission of the candidate to the city council.

Sec. 27-3.  Employee exemption from certain rules.

The sections of this chapter governing activities and the general rules are not applicable to employees of the city while within a park on required or official duties and in the course of such employment.

Sec. 27-4.  Protection to trees and shrubbery.

No person shall pick or cut any wild or cultivated flowers, or cut, break, dig or in any way deface any tree, shrub or plant within the limits of any park.

Sec. 27-5.  Protection to prohibited areas.

No person shall go on foot or otherwise upon the grass or turf of any park or parkway where any prohibitory sign is posted.

Sec. 27-5.1.  Playing golf.

No person shall golf within any park within the city, except in areas designated by the parks and recreation department as a golf course or driving range.

Sec. 27-6.  Injuring park property.

No person shall cut, break, scratch, mark, mar, or in any way injure or deface any building, fence, wall lamp, flagpole, construction improvement, facility or any other feature or property upon or within any park.

Sec. 27-7.  Vehicle operation and parking.

No person shall operate or park any vehicle in any park, except on clearly marked and designated roadways or parking areas therein, except as authorized by the director pursuant to policy established by the board.

Sec. 27-8.  Littering prohibited.

(a)     No person shall throw, deposit, place, or leave in any park or parkway, or water therein, any paper, rubbish, waste, cans, bottles, or refuse of any kind, whether or not such is offensive to the senses or is injurious to health, except in the receptacles provided for waste.

(b)     No person shall deposit, place, or leave any waste materials in any waste receptacle in any park which has not been generated within the park.

Sec. 27-9.  Restrictions on abutting landowners.

No owner, occupant or person in charge of any land abutting upon any park shall allow any earth, rubbish or refuse of any kind, whether or not such is offensive to the senses or injurious to health, to blow, to fall or to wash upon or into any park.

Sec. 27-10.  Handbills and signs prohibited.

Except when permitted in writing by the director, no person shall erect any signs or posts or affix any notice or bills or other writing to any tree, post, wall, fence or building or any other structure or improvement within any park.

Sec. 27-11.  Firearms, guns and fireworks prohibited.

No person shall fire or discharge any gun or any other type of firearm or discharge or set off any type of rocket, firecracker, or other fireworks or anything containing any substance of an explosive character within any public park except as authorized by the director pursuant to policy established by the board.

Sec. 27-12.  Animals protected.

No person shall harm any bird nest within the limits of any park, nor aim or discharge any airgun, slingshot or other weapon, or throw any stones or other missiles at, nor injure, or attempt to injure any bird or wild creature within any park.

Sec. 27-12.1.  Feeding and keeping waterfowl.

(a)     No person shall:

(1)     Feed any waterfowl in or immediately adjacent to the city bike trails and any city park, excluding Arrowhead Park and the Great Plains Zoo;

(2)     Distribute any food for waterfowl in Terrace Park or Covell Lake or otherwise distribute food for waterfowl within the area of the city bordered by North West Avenue, North Walts Avenue, West Bailey Street, and West Sixth Street, which food is, or can be, edible by waterfowl;

(3)     Operate, install, or cause to be installed, any aerator in Covell Lake;

(4)     Take any action to keep waterfowl within the bordered area described herein or in or immediately adjacent to the city bike trails and any city park, excluding Arrowhead Park and the Great Plains Zoo, including any action to intentionally break or open the ice in Covell Lake.

(b)     Signs giving notice of the prohibitions of this section shall be conspicuously placed by the director.

Sec. 27-13.  Trapping prohibited.

No person shall possess any device with the intent to use the device to capture any wild creature in any park with the exception of those devices which are necessarily used for fishing in the streams and lakes within the park system as so permitted in other portions of this chapter and except as permitted by section 7-13 of this Code.

Sec. 27-15.  Fees; requirements for use of park facilities.

(a)     The board shall recommend fees for the use of parks and park facilities operated by the city. Individuals desiring to use facilities for which a fee is charged shall enter and exit at the designated place and use only designated areas.

(b)     The board may permit private persons or organizations to use designated portions of parks for uses or events for which the user may charge a fee for participation in or attendance at such events. A notice that the use or event is not city-sponsored shall be posted at the entrance. The board shall establish policies and procedures for such park use.

Sec. 27-15.1.  Transfer of season passes.

No person shall transfer to another person any annual pass for privileges at park facilities, including but not limited to, swimming pools, tennis courts, skiing, golf courses, and the zoo. Punch passes may be transferred.

Sec. 27-16.  Permits required for use of parks.

Permits to be in the park after hours or for reservation of special area usage or as allowed in this chapter shall be obtained from the director before the time the activity is to take place. Requests for permits shall be made in writing and when a permit is granted or refused, notice of the action taken shall be given to the police chief and the requesting party.

Sec. 27-16.1.  Rules for permit authorization.

The director shall issue a permit under section 27-16 of this chapter when he finds that:

(1)     The proposed activity and use will not unreasonably interfere with or detract from the promotion of public health, welfare, safety and recreation.

(2)     The proposed activity or use is not reasonably anticipated to invite violence, crime or disturbance of the peace.

(3)     The proposed activity will not entail unusual, extraordinary or burdensome expense or police operation by the city.

(4)     The facilities desired have not been reserved for other use on the day and hour requested in the application.

Sec. 27-16.2.  Procedure for appealing director's refusal for permit.

Within five working days after receipt of an application for a permit required in this article, the director shall inform an applicant in writing of his reasons for refusing a permit, and any aggrieved party shall have the right to appeal in writing within ten days to the board, which shall consider the application under the standards for issuance set forth in this article and sustain or overrule the director's decision within five days. A permittee shall be bound by all applicable park ordinances. The director shall have authority to revoke a permit upon a finding of violation of any rule or ordinance or upon good cause shown. Further appeal of decisions of the park board and park director may be made in accordance with the Revised Ordinances of Sioux Falls, SD, Chapter 2, Article VI, Section 2-60 et sequence of this code.

Sec. 27-16.3.  Selling prohibited except by agreement or permit.

No person shall promote, sell or offer to sell any article or anything of any type in any park, except as permitted by the board through agreement or permit.

Sec. 27-16.4.  Fires in parks.

No person shall start any fire in any park except in those places provided therefor. Every person who starts or uses a fire shall completely extinguish the fire before leaving the park.

Sec. 27-16.5.  Permit required for certain activities.

No bands, processions, parades, military displays, entertainment, exhibitions or public meetings shall be allowed in any park nor may any person reserve a picnic shelter or portion of any park unless authorized in writing by the director pursuant to policy established by the board.

Sec. 27-16.6.  Hours parks open to public.

(a)     Except as permitted herein, no person shall be in any park between 10:00 p.m. and 5:00 a.m.

(b)     While daylight savings time is in effect, Falls Park shall remain open between 5:00 a.m. and 12:00 midnight.

(c)     While daylight savings time is in effect, Fawick Park shall remain open between 5:00 a.m. and 11:00 p.m.

Sec. 27-16.7.  Vehicles after hours.

No person shall park or leave parked a vehicle within any park after closing hours unless authorized by the director.

Sec. 27-16.8.  Utility easements.

Requests for utility easements to be located on city park property which is the responsibility of the board shall be submitted to the board for approval.

Sec. 27-16.9.  Comprehensive parks and recreation system plan.

It shall be a function and a duty of the park board to submit a comprehensive parks and recreation system plan. The director shall provide the park board with a comprehensive parks and recreation system plan, and such plan shall be in conformance with the city's comprehensive land use plan. The comprehensive parks and recreation system plan will include an inventory of existing conditions with recommendations for future programs and services, for acquisition and development of areas, and for any necessary facility improvements. The plan will include parks department administration plans, goals and operational objectives, population and other socioeconomic trends, demand projections for park and recreation facilities and personnel, as well as anticipated capital improvement and equipment needs by the department. The park board shall approve the plan and submit it to the city council for adoption. It shall be updated at least every five years.

Sec. 27-16.10.  Site master plans.

Site master plans for any new or expanded park shall be prepared by the director, approved by the park board and the city council. Site master plans shall include, but not be limited to, overall development of existing and proposed facilities, and proposed capital improvement projects. Inclusion of any park development project in the capital improvement program shall be reviewed and approved by the board and shall be in general conformance with an approved site master plan or the comprehensive parks and recreation system plan.

Sec. 27-16.11.  Alcoholic beverages.

(a)     No person shall consume any alcoholic beverages in the following city parks: Whittier, McKennan, Tuthill, Tomar, Heritage, Lyon, Kenny Anderson, Pasley, Arrowhead, and Veterans’ Memorial Park.

(b)     No person shall consume any alcoholic beverages in Falls Park, Fawick Park, or any park property located adjacent to and within 500 feet of the Big Sioux River between Falls Park Drive south to the Cliff Avenue bridge located between 12th Street and 14th Street, except upon application meeting the requirements of SDCL 35-4-11.4 and approval by the city council.

(c)     In all other city parks, no person shall consume any alcoholic beverages, except that the restriction shall not apply to malt beverages or wine as defined by SDCL 35-1-1, or where alcoholic beverages are licensed to be sold.

Sec. 27-16.12.  Fishing.

Fishing shall be permitted in Covell Lake and Sertoma Lake at such times as may be determined by the director. The director shall post notice to the public at conspicuous places of the time when fishing is permitted at each lake. No person shall fish in Covell Lake and Sertoma Lake at any time not authorized by the director.

Sec. 27-16.13.  Bicycling.

Bicycle riders in the parks shall abide by the ordinances governing the operation and equipment of bicycles except bicycling need not be limited to paved areas. Bicyclists shall operate their bicycles in a prudent manner and with due regard for the safety of others and the preservation of park property.

Sec. 27-16.14.  Authority of director to prohibit certain conduct; notice.

The director pursuant to policy established by the board may prohibit conduct in those areas of the parks when and where the director deems conduct dangerous or unduly interfering with another's use of the parks, such as but not limited to picnicking areas. A notice prohibiting activity within a specific area shall be conspicuously displayed setting forth which activity, conduct or games are restricted.

Sec. 27-16.15.  Glass containers.

No glass beverage containers are permitted in any park.

ARTICLE II.  PARK AND RECREATION BOARD*

Sec. 27-17.  Created.

There is hereby created a park and recreation board for the city, to be known as the Sioux Falls Park and Recreation Board. The board shall act as an advisory body to the mayor in all executive and administrative matters, and to the city council in all policy making and legislative matters affecting the establishment, improvement, maintenance, regulation and management of a system of public parks, zoological parks, parkways, and boulevards and public recreation, playgrounds and children's parks in and for the city.

Sec. 27-18.  Composition.

The park and recreation board shall be composed of seven members, each of whom shall be a registered voter of the city.

Sec. 27-19.  Members holding elective office.

The members of the park and recreation board shall not hold any elective office in the government of the city.

Sec. 27-20.  Appointment.

The members of the park and recreation board shall be appointed by the mayor with the advice and consent of the city council.

Sec. 27-21.  Terms.

The members appointed to the park and recreation board shall serve for five-year staggered terms. Such appointees shall hold office until their successors are appointed and qualified.

Sec. 27-22.  Vacancies.

Any vacancy on the city park and recreation board shall be filled for the unexpired term of the member vacating such board in the same manner as is required for a regular appointment.

Sec. 27-24.  Officers.

At the first regular meeting of the park and recreation board in December of each year, the board shall elect from its number a president, a vice-president, and a secretary, each of whom shall serve until December 31 of the following year. The vice-president shall act in the absence or disability of the president. In case of death or retirement of an officer, a successor shall be elected immediately.

Sec. 27-25.  Meetings, orientation.

The park and recreation board shall hold regular meetings at least once each month and as many special meetings as it deems proper. An orientation shall be provided for all members. The orientation shall include, but not be limited to chapters 27 and 12 1/2 of this Code.

Sec. 27-26.  Quorum.

Four members of the park and recreation board shall constitute a quorum for the transaction of business.

Sec. 27-27.  Affirmative vote for action.

An affirmative vote of at least four members of the park and recreation board shall be necessary to authorize any action of the board.

Sec. 27-27.1  Bylaws.

The park and recreation board shall adopt by-laws consistent with this chapter.

Sec. 27-28.  Records, reports.

The director shall keep a record of its proceedings, file such record with the city clerk, and make such reports as may be required by the board. The records of the board filed with the city clerk or copies of any such records when duly certified by the city clerk shall be competent evidence of the proceedings of the board.

Sec. 27-28.1.  Annual report.

The park and recreation board shall file a summary annual report of its activities with the city clerk not later than January 31 of each year.

Sec. 27-29.  Duties generally.

In addition to those specifically set out in other sections of this code, the board shall have the following duties:

(1)     To initiate, review, and make recommendations for ordinances, policies, and rules governing the use of the city's public parks, swimming pools, and other facilities in connection therewith including the golf courses.

(2)     To provide the city council with a comprehensive parks and recreation system plan.

(3)     To develop plans based upon projected growth and expansion of the city for future park needs, locations, and necessary facilities.

(4)     To initiate and review parks and recreation programs, and to make recommendations to the mayor and city council for their adoption.

(5)     To review and make recommendations to the mayor and city council on any matters affecting the establishment, improvement, maintenance, and regulation of the parks, including any proposed revisions to Chapter 27. Such issues shall be submitted to the board for recommendation prior to official action.

(6)     Advise and assist the parks and recreation director relative to parks and recreation.

ARTICLE III.  FEES

Sec. 27-40.  Definitions.

The following words, when used in this Article, shall have the meaning ascribed to them in this section, except where the context clearly indicates a different meaning:

Infant means a person between the ages 0 to less than two years old.

Child means a person between the ages 2-15.

Adult means a person between the ages 16-54.

Senior citizen means a person age 55 and older.

Family means immediate family members living in the household, including step and foster children. It does not mean extended family such as grandparents, aunts, uncles, etc.

Individual means a person considered an adult as defined above.

Sec. 27-41.  Recreation activity and facility fees.

The following fees, inclusive of all applicable taxes, shall be charged for city recreation activities and use of park and recreation facilities.

ARTICLE IV.  SIOUX FALLS ICE AND RECREATION CENTER BOARD

Sec. 27-50.  Created.

There is hereby created the Sioux Falls Ice and Recreation Center Board.

Sec. 27-51.  Composition.

The recreation center board shall be composed of five members appointed by the mayor with the advice and consent of the city council. The membership shall include a representative of a city youth hockey organization, a representative of a city youth figure skating organization, a representative of the Thomas White Eye Institute, and a lay person of the community.

Sec. 27-52.  Terms.

The term of each member of the board shall be for five years, or until a successor is appointed and qualified.

Sec. 27-53.  Officers.

The board shall elect from its members a president and vice president, each of whom shall serve for a term of one year or until a successor is elected and qualified. The vice president shall act in the absence or disability of the president. In case of death or resignation of an officer, a successor shall be immediately elected.

The board shall hold at least one meeting each year.

Sec. 27-56.  Powers and duties.

The board shall advise the facility manager, the city park and recreation board, the mayor, and the city council regarding fees for use of the facility; ice time for public figure skating, open skating, hockey, and other uses; and any sale of the facility or discontinuance of its use as an ice rink. Such advice will include suggestions for a replacement facility.
